How Does the NVICP Claim Process Work?

For vaccine-related injuries, there is a unique process. Claims are filed in the United States Court of Federal Claims in Washington, D.C. The NVICP claim process can take as little as 6 months or as long as a few years.

  1. A Claim for a Vaccine-Related Injury is Filed

    A claim is filed in the United States Court of Federal Claims against the Secretary of the Department of Health & Human Services.

  2. The NVICP Claim Review Process Begins

    Two government agencies review the claim and make compensation recommendations:

    • The Department of Health and Human Services conducts a medical review of the petition.
    • The Department of Justice issues a legal report including the medical review and submits it to the US Court of Federal Claims.
    • A court-appointed special master looks at the report, holds a hearing, and then decides.

  3. Court steps in

    If the government agencies do not recommend compensation or, if the parties dispute the special masters findings, then the Court of Federal Claims will decide whether compensation to the injured person is appropriate.

Who Can File an NVICP Claim?*

Individuals

Anyone who received a vaccine covered by the NVICP and believes they were injured by it. You do not need to be a US citizen to receive compensation.

Legal Representatives

The legal representative of the estate of a deceased person who received a vaccine covered by the NVICP and believes that the person’s death resulted from the vaccine injury.

Additionally, the Symptoms of a Vaccine Injury Must Meet At Least 1 of the Following Criteria

  • Last for more than 6 months after the vaccine is given
  • OR
  • Result in a hospital stay and surgery
  • OR
  • Result in death
